These Terms & Conditions ("Terms") govern your use of the Loving Memoirs website at https://loving-memoirs.com/ and our mobile app (together, the "Site"), and your purchase of memorial pages and plaques with QR codes ("Products") from Loving Memoirs. By accessing the Site and/or purchasing Products from Loving Memoirs, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Site or purchase Products from Loving Memoirs.

Acceptance of terms

By accessing the Site and/or purchasing Products, you agree to be bound by these Terms. Loving Memoirs reserves the right to update or modify these Terms at any time without prior notice. Your continued use of the Site and/or purchase of Products after any such changes constitutes your acceptance of the updated Terms.

Products and orders

Loving Memoirs sells memorial pages and plaques with QR codes that link to those pages. By purchasing Products, you agree to provide accurate and complete information for your order. Loving Memoirs reserves the right to refuse or cancel any order for any reason, including but not limited to inaccuracies in product descriptions or pricing errors.

Intellectual property

All content on the Site, including but not limited to text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of Loving Memoirs or its content suppliers and is protected by copyright law. You may not use, reproduce, modify, distribute, display, or create derivative works of any content from the Site without the express written consent of Loving Memoirs.

QR code memorial pages

Loving Memoirs provides QR codes that link to memorial pages. You are solely responsible for the content of any memorial page linked to by a QR code purchased from Loving Memoirs. Loving Memoirs reserves the right to remove any memorial page linked to by a QR code if it violates these Terms or any applicable law.

Limitation of liability

To the fullest extent permitted by law, Loving Memoirs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, use, or goodwill, arising from your access to or use of, or inability to access or use, the Site or Products; any conduct or content of any third party on the Site; any content obtained from the Site; or unauthorised access, use, or alteration of your transmissions or content — whether based on warranty, contract, tort (including negligence), or any other legal theory, and even if Loving Memoirs has been advised of the possibility of such damage.

Indemnification

You agree to indemnify, defend, and hold harmless Loving Memoirs, its affiliates, and their respective officers, directors, employees, agents, licensors, and suppliers from and against all claims, losses, liabilities, expenses, damages, and costs, including reasonable legal fees, resulting from any violation of these Terms or any activity related to your account — including negligent or wrongful conduct — by you or any other person accessing the Site using your account.
